DISCLAIMER
1. Wyoming.com is a commercial organization dedicated to improving business,
educational, and individual opportunities via the Internet. Accordingly, Wyoming.com's objectives are:
a. To
provide Internet access to all businesses, educational users,
and individuals.
b. To provide data transport between Wyoming.com users and
the rest of the Internet.
c. To allow commercial, educational, and individual users
data transport among themselves.
d. To expand the data communication options within the Rocky Mountain West.
Much of the
content available on Wyoming.com's service is owned by others.
This content is protected by copyright, trademark and other intellectual
property laws. Any content that you upload or download while using
Wyoming.com must be authorized. This means you must have the legal
right to upload or download the content. Making unauthorized copies
of any content found on Wyoming.com can lead to the termination
of your Wyoming.com account. This conduct may also subject you
to further legal action. Additionally, the unauthorized submission
of copyrighted materials or other proprietary content constitutes
a breach of Wyoming.com's Acceptable Use Policy (AUP). This type
of breach could subject the uploader to criminal prosecution as
well as personal liability for damages in a civil suit. Owners
of the protected material may take criminal or civil action against
you. In that event, you agree to hold harmless Wyoming.com and
its subsidiaries, affiliates, related companies, employees, officers,
directors and agents.
Users of the Wyoming.com network will:
Remember that they are interacting on a Global network and act
appropriately.
Avoid interfering with the work of other users.
Avoid disrupting the network host systems.
Avoid disrupting network services.
Privacy Policy:
Customer information including, without limitation, name, Internet activity or financial history shall be released only on receipt of written permission signed by the person affected or in response to a subpoenna or order from a court of competent jurisdiction .
2. VIOLATIONS
OF Wyoming.com'S ACCEPTABLE USE POLICY (AUP)
The following
practices constitute violations of the AUP and will not be tolerated.
Users found knowingly practicing them may, in the discretion of
Wyoming.com, lose their account with Wyoming.com. Should Wyoming.com
believe that a criminal statute has been violated, it will immediately
inform the proper authorities.
a. ILLEGAL
USE. Using the Services to transmit any material (by email,
uploading, posting, or otherwise) that, intentionally or unintentionally,
violates any applicable local, state, national or international
law, or any rules or regulations promulgated thereunder.
b. HARM
TO MINORS. Using the Services to harm, or attempt to harm,
minors in any way.
c. THREATS. Using the Services to transmit any material (by email, uploading,
posting, or otherwise) that threatens or encourages bodily harm
or destruction of property.
d. HARRASSMENT. Using the Services to transmit any material (by email, uploading,
posting, or otherwise) that harasses another.
e. FRADULENT
ACTIVITY. Using the Services to make fraudulent offers to
sell or buy products, items, or services or to advance any type
of financial scam such as "pyramid schemes," "Ponzi
schemes," and "chain letters." Deceptive on-line
marketing practices are also considered fraudulent activities.
The FTC will bring cases against these types of marketing schemes.

f. FORGERY
OR IMPERSONATION. Adding, removing or modifying identifying
network header information in an effort to deceive or mislead
is prohibited. Attempting to impersonate any person by using forged
headers or other identifying information is prohibited. The use
of anonymous re-mailers or nicknames does not constitute impersonation.
Using deliberately misleading headers ("munging" headers)
in news postings in order to avoid spam email address collectors
is allowed.
g. UNSOLICITED
COMMERCIAL EMAIL/UNSOLICITED BULK EMAIL. Using the Services
to transmit any unsolicited commercial email or unsolicited bulk
email. Activities that have the effect of facilitating unsolicited
commercial email or unsolicited bulk email whether or not that
email is commercial in nature, are prohibited.
h. UNAUTHORIZED
ACCESS. Using the Services to access, or to attempt to access,
the accounts of others, or to penetrate, or attempt to penetrate,
security measures of Wyoming.com's or another entity's computer
software or hardware, electronic communications system, or telecommunications
system, whether or not the intrusion results in the corruption,
theft or loss of data.
i. COPYRIGHT
OR TRADEMARK INFRINGEMENT. Using the Services to transmit
any material (by email, uploading, posting, or otherwise) that
infringes any copyright, trademark, patent, trade secret, or other
proprietary rights of any third party, including, but not limited
to, the unauthorized copying of copyrighted material, the digitization
and distribution of photographs from magazines, books, or other
copyrighted sources, and the unauthorized transmittal of copyrighted
software.
j. COLLECTION
OF PERSONAL DATA. Using the Services to collect, or attempt
to collect, personal information about third parties without their
knowledge or consent.
k. RESELLING
THE SERVICES. Reselling the Services without Wyoming.com's
written authorization. No subscriber shall provide access to the
Wyoming.com network to any other person, or shall sell, resell,
share, give, or provide, either separately or in conjunction with
any other service or amenity, access to any of the services provided
by Wyoming.com.
l. NETWORK
DISRUPTIONS AND UNFRIENDLY ACTIVITY. Using the Services for
any activity which adversely affects the ability of other people
or systems to use Wyoming.com services or the Internet. This includes
"denial of service" (DoS) attacks, viruses, Trojan horses,
worms, and other types of malicious programs against another network
host or individual user. Interference with or disruption of other
network users, network services or network equipment is prohibited.
It is the User's responsibility to ensure that their network is
configured in a secure manner. A User may not, through action
or inaction, allow others to use their network for illegal or
inappropriate actions. A User may not permit their network, through
action or inaction, to be configured in such a way that gives
a third party the capability to use their network in an illegal
or inappropriate manner.
Introducing
viruses, Trojan horses, worms, and other types of malicious programs
into the Wyoming.com network, and thereby the Internet, will be
prosecuted to the fullest extent of the law
m. NEWS. Wyoming.com Users should use their best judgment when posting
to any newsgroup. Many groups have charters, published guidelines,
FAQs, or "community standards" describing what is and
is not considered appropriate. Usenet can be a valuable resource
if used properly. The continued posting of off-topic articles
is prohibited. Commercial advertisements are off-topic in most
newsgroups, especially regional groups not specifically named
for such. The presence of such articles in a group is not indicative
of the group's "intended" use. Please familiarize yourself
with basic Usenet netiquette before posting to a newsgroup.
Wyoming.com
Users may not cancel messages other than their own messages. A
User may cancel posts forged in that User's name. We may cancel
any postings which violate this AUP.
n. MIS-USE
OF SERVICES. Using a personal or residential account for commercial
use is prohibited. Commercial use is defined as hosting a server
of any type using your Wyoming.com service (see next section for
information about WEB SITE AND SERVER POLICY). The Services are
intended for personal use to include: active use of email, newsgroups,
file transfers, Internet chat, games, and browsing the World Wide
Web. Users may maintain a dialup connection so long as they are
actively using that connection for the above purposes. Users may
not use the Services on a standby or inactive basis in order to
maintain a dialup connection. Accordingly, Wyoming.com maintains
the right to terminate any User's dialup connection following
any extended period of inactivity as determined by Wyoming.com.
o. WEB
SITE AND SERVER POLICY.
Only commercial users are authorized to host appropriate commercial servers, to include web servers, ftp servers, email servers, etc., as part of their Wyoming.com Internet agreement. All materials hosted on such commercial servers must adhere to the items outlined in this AUP. Commercial users are defined as those parties that purchase a Wyoming.com Business Internet service and sign a Wyoming.com Business Services Agreement.
This Acceptable
Use Policy is not meant to be a straightjacket on using Wyoming.com
or the Internet networks. By simply conforming to this policy,
all users create an environment where communication can flow freely
and with a minimum of policing.
DISCLAIMER
The Internet is a network of unrelated telecommunications facilities,
computers and computer software that provide for the exchange of
information. As such, it is subject to many different points of
failure, under the control of no single entity or individual, and
cannot be assumed to be available for use at any given moment. It
should under no circumstances be relied upon as the only means of
communication of important information. Users therefore agree to
hold Wyoming.com and its subsidiaries, affiliates, related companies,
employees, officers, directors and agents harmless in the event
of the user's inability to access or communicate via the Internet.
